Il 3 marzo 2010 il TAR del LAZIO (Sezione Terza Bis) si è pronunciato sui ricorsi presentati contro il Piano Programmatico e contro i Regolamenti sul Primo Ciclo d’Istruzione (D.P.R. n.89/09) e sulla razionalizzazione della rete scolastica (D.P.R. n. 81/09). Con questa Sentenza che respinge i ricorsi, a mio parere, il TAR del Lazio ha scritto una delle più brutte pagine della giustizia amministrativa nel nostro paese. Si tratta di una valutazione meramente tecnica che sarà necessario, come cercheremo di fare, sottoporre insieme alla Sentenza ad un vasto dibattito in tutte le sedi, giudiziarie, accademiche e di studio, in cui operano cittadini e studiosi a cui sta a cuore il rispetto della giustizia e della legalità repubblicana. I TAR in questo paese possono legittimamente decidere sui modi di applicazione di una legge ma il loro operato in termini tecnici può essere sempre tranquillamente valutato perché resta scritto a fronte di argomentazioni scritte dai ricorrenti e ai testi scritti oggetto delle contestazioni. Gli argomenti addotti devono avere un contenuto logico e non si possono omettere le risposte.
Proprio queste due condizioni mi sembrano ripetutamente ignorate e omesse nella sentenza del TAR in questione.
