In merito ad alcune notizie apparse sulla stampa locale e milanese che hanno riguardato la questione delle tasse all’Istituto Bachelet di Abbiategrasso, la Flc-Cgil di Milano ritiene doveroso sia fatta chiarezza nell’interesse primario degli utenti e del buon funzionamento della scuola.
La materia è tra quelle che si prestano ad essere gestite con ambiguità e che viene a cadere in un momento di particolari difficoltà non solo per le scuole ma anche per le famiglie. E’ risaputo da tempo che ogni scuola mediamente vanta crediti nei confronti del Miur di 150/200mila euro.
I tagli più recenti hanno peggiorato la situazione, costringendo sempre più le scuole per poter funzionare a chiedere aiuto ai genitori degli alunni, con tasse e contributi di varia natura.
Sull’argomento sono intervenuti più volte sia il Parlamento sia lo stesso Ministero.
Per l’anno in corso la Circolare n.6 del 21.1.09 ha precisato i limiti di reddito per la concessione dell’esonero dalle tasse scolastiche erariali ai nuclei familiari più indigenti.
La stessa ministeriale nel richiamare le CC.MM. n.2 del 4.1.06 e n.13 del 30.1.07 nonché l’art.1, comma 622 della L.296 del 27.12.06 (finanziaria del 2007) ribadisce che resta fermo il regime di gratuità, confermando l’esonero dal pagamento delle tasse scolastiche erariali oltre che per gli studenti a basso reddito anche per tutti gli studenti iscritti alle classi 1, 2, 3 della secondaria, in quanto destinari del diritto-dovere all’istruzione. Va da sé che in tutta la scuola dell’obbligo del 1° ciclo, iscrizione e frequenza sono gratuite.
Le tasse rimangono in vigore esclusivamente per gli studenti delle classi 4 e 5 della secondaria, non esonerati per motivi di reddito e che ammontano a € 6,04 per l’iscrizione e € 15,13 per la frequenza.
Resta assolutamente vietato per le scuole, al di fuori di quanto sopra indicato, imporre tasse di altra natura o contributi a carattere obbligatorio.
Tutto ciò che esula da una legittima richiesta di rimborso spese ( ad es. l’assicurazione individuale RC e infortuni, spese per uscite didattiche e viaggi d’istruzione, libretto delle assenze..) assume carattere di contributo volontario e facoltativo. Tale condizione per motivi di trasparenza oltre che di correttezza va indicata nella delibera del consiglio d’istituto e, soprattutto, nella comunicazione con le famiglie degli studenti. Tale contributo non può essere richiesto né versato senza la predetta delibera. Una volta chiarito il carattere facoltativo e volontario del contributo, spetta alle famiglie e soltanto a loro in piena libertà e senza subire pressioni, decidere di darlo o non darlo. Se si decide di darlo il contributo va versato sul conto corrente della scuola o tramite bonifico bancario o tramite bollettino postale. Solo così è possibile detrarre il contributo nella dichiarazione dei redditi (rigo E 19 – codice 31 ) in base alla legge Bersani n.40/07 .
Il contributo che viene chiesto alle famiglie non può essere usato per coprire spese a carico dello Stato o degli Enti Locali, va inserito nel Programma annuale e ogni anno,a consuntivo, rendicontato dettagliatamente.
Sta all’autonomia e alla responsabilità del Dirigente Scolastico informare in maniera corretta e trasparente i genitori, evitando ogni ambiguità e soprattutto ogni effetto discriminatorio tra le famiglie e gli studenti.
