Decreto Brunetta: non dire gatto se non ce l'hai nel sacco

Abbiamo letto in questi giorni sulla stampa cittadina, dei maldestri tentativi di qualche Dirigente Scolastico, di voler a tutti i costi anticipare i contenuti della cosiddetta riforma Brunetta, vale a dire quella parte del Dlgs. n.150/09 che affronta le questioni del merito e della premialità nei contratti integrativi d’istituto 09/10.

Ben coscienti che nell’attuale scenario contrattuale ( 06-09 ) risulta molto difficile se non impossibile attuarle, questi Dirigenti, pochi per la verità, s’arrampicano sugli specchi pur di prendersi spazi e facoltà di poter decidere discrezionalmente la distribuzione del salario accessorio , previsto dal Fondo dell’istituzione scolastica.
Siccome il dlgs. 150/09 rinvia l’applicazione del merito e della premialità ad un apposito DPCM, però limitatamente ai docenti della scuola, dell’AFAM e ai ricercatori dell’Università, ecco che qualcuno ci prova col personale ATA.

Certo il decreto Brunetta al riguardo prevede tre livelli e di queste solo chi sta nei primi due è premiato col salario accessorio mentre chi sta nel terzo livello va in buca e non becca nulla.
Ecco allora spuntare dal cilindro una differenziazione salariale di tutte le risorse del FIS destinate al personale ATA, magari su tre o quattro livelli, basata non sulle attività svolte più o meno aggiuntive o sulla intensificazione dei carichi di lavoro, ma sul lavoro svolto l’anno precedente.
Una sorta di pagellina stilata per ogni dipendente ATA che così viene incasellato in uno dei tre o quattro livelli, cui corrisponde un riconoscimento differenziato del salario accessorio.
Il tutto mascherato da una pseudo intensificazione all’interno dell’orario di lavoro, senza alcuna definizione dei parametri che attengano alla misurazione dei maggiori carichi di lavoro o del maggiore impegno nel proprio reparto o alla intensificazione stessa.
Avendo come unico riferimento il lavoro svolto l’anno precedente, va da sé che il tutto diventa una valutazione di merito, discrezionale per giunta ma che nessuna norma contrattuale attualmente riconosce al Dirigente scolastico .

Il Fondo d’istituto è finalizzato a riconoscere prestazioni aggiuntive oltre l’orario di lavoro e/o l’intensificazione per maggior carico di lavoro all’interno dell’orario .
Il riconoscimento del merito, pur se condivisibile in linea di principio, non ha allo stato attuale e nella cornice contrattuale odierna alcuna sponda attuativa né per i docenti né per il personale ATA.
Se questa partita si presenta molto complessa sui docenti tanto da richiedere un apposito DPCM non è nemmeno così automatica se riferita al personale ATA.
Innanzitutto, merito e premialità richiedono risorse dedicate, distinte da quelle destinate al fondo d’istituto che riconosce solo prestazioni aggiuntive e/o maggiori carichi di lavoro o maggiori disagi
derivanti ad es. dalla flessibilità dell’orario.

Per il personale ATA non è previsto un apposito DPCM come per i docenti ma sicuramente il nuovo contratto nazionale triennale (10/12 ) avrà qualche voce in capitolo.
Quindi per adesso quei Dirigenti, entusiasti del decreto Brunetta che non vedono l’ora di avere le mani libere per decidere sul merito dei loro dipendenti, stiano buoni senza fantasiosi quanto inutili contorcimenti contrattuali .
Ma soprattutto, " non dire gatto se non ce l’hai nel sacco" .
La strada è lunga e ancora tutta in salita perciò si raccomanda di non prendere scorciatoie che possano rivelarsi molto più impervie della via maestra .
